How do helmet laws and usage impact motorcycle accident outcomes?

On Behalf of | Oct 25, 2024 | Motorcycle Crashes, Personal Injury |

Motorcycle helmet use decreases the probability of death by about 42% and the likelihood of head injuries by approximately 69%. However, their effectiveness is influenced by various factors, including legislation.

Injuries during a motorcycle accident

Helmets absorb impact and protect the skull during crashes, reducing the risk of traumatic brain injuries, skull fractures, and facial damage, studies have shown consistently. While they significantly reduce the risk of head injuries, they cannot eliminate all dangers associated with motorcycle accidents. Riders can still suffer from other types of harms, such as:

  • Arms and legs injuries
  • Torso injuries
  • Spine and back injuries

Additionally, a helmet’s effectiveness depends on whether it is an open-face or full-face helmet, proper fit, correct wearing and condition. The speed at which an accident occurs also plays a role, as helmets have limitations in extremely high-speed crashes.

The impact of helmet laws

States with universal helmet laws, which require all riders to wear helmets, generally see higher rates of helmet use and lower rates of head injuries than states with partial laws, such as Michigan.

In universal law states, helmet use ranges from 85% to 92%. In contrast, in partial law states, it drops to 29% to 54%, resulting in notable differences in injury rates and severity.  In partial law states, head injuries are 1.4 times more common, and facial injuries are 1.5 times more prevalent compared to universal law states.

In states with partial helmet laws, motorcycle riders involved in crashes faced higher median emergency department charges ($1,987) than those in universal helmet law states ($1,443). Similarly, median hospital charges were higher in partial law states ($31,506) than in universal law states ($25,949).

Seeking legal help after a motorcycle accident can be advisable, especially in cases involving severe injuries or disputes over liability. Lawyers experienced in motorcycle accidents can help navigate complex insurance claims, ensure fair compensation for injuries, and address any legal issues related to helmet use or compliance with state laws.

Motorcycle helmets are essential equipment. However, they are just part of motorcycle safety. Riders should also wear appropriate protective gear, maintain their motorcycles, and stay alert to road conditions and other vehicles.
